Sydney Cole, 23, faces a three-year sentence if convicted in the April 15, 2019 incident that left Corporal Sarah Garrity, 26, in intensive care after losing four pints of blood and needing 14 stitches in a neck wound.Cole, born in Hertfordshire, was arrested on suspicion of attempted murder and briefly jailed in Mallorca before being released pending an ongoing investigation.Today, the respected island newspaper Última Hora said she had been charged with bodily injury in an indictment brought before a court in Palma and that she faced a three-year prison sentence if found guilty at trial.Prosecutors in the Mallorcan capital drafted the indictment against her even though Sarah, 26, told Spanish authorities early on in the investigation that she did not want to press charges and waived her right to compensation.
The date of the trial has not yet been made public, but it is expected to take place before the end of the year.The latest development in the long-running case comes 18 months after it emerged that a Palma court had issued an international arrest warrant for Cole following failed attempts to inform her that she was wanted for a new questionnaire under oath.Judicial sources at the time said her indictment for the attack was “just a matter of time” and explained that the Palma judge who issued the order had decided to take action after she breached bail conditions by changing address without notify the Spanish authorities.It was not immediately clear if the arrest warrant was still in effect or if Cole, based at Fort George Barracks in Inverness when she was arrested, deactivated it by contacting court officials and making himself available for further questioning.
