Sayfullo Saipov, 35, the man convicted of killing eight people on a New York City bike path in 2017 was spared the death penalty Monday after a federal jury failed to reach a unanimous decision.

Sayfullo Saipov will now be sentenced to life in prison without parole, spending the rest of his days in Colorado’s Supermax facility, the most secure federal prison in the US. He was convicted in January of brutally murdering eight people with the goal of joining the Islamic State terrorist organization. Saipov’s case is the first federal death penalty trial since President Joe Biden, a Democrat, took office in 2021 after promising to abolish the death penalty during his campaign.

On Monday, the jury indicated that it did not unanimously agree that Saipov was likely to commit criminal acts of prison violence in the future. However, they agreed that Saipov planned the attack in advance and carried it out in support of the terrorist organization. At the same time, they also agreed on several mitigating factors, including that many of Saipov’s family members still love him despite what he had done and that a life sentence provides hope that one day he will realize that what he did was wrong.

During the sentencing phase of the trial, jurors heard from attack survivors who testified about his continued suffering and from jail officials who described Saipov’s outbursts and threats since his arrest. The defendant is still committed to jihad, ISIS and violence,” prosecutor Amanda Houle said in her closing argument on March 7. Saipov’s defense attorney, David Patton, said in his closing argument that the death penalty “was not necessary to do justice.” He said Saipov would spend 22 or 23 hours a day alone in a cell with a cement bed if he were sentenced to life in prison.

The last time someone was sentenced to death for a federal crime in the Empire States was in 1954. The jury’s vote must be unanimous or Saipov will go to prison for life.
