A San Diego couple sued Hyatt Hotel Corporations for the wrongful death of their son, Nico Carter. The 23-month-old boy fell from the ninth floor balcony of the Hyatt Ziva Puerto Vallarta in Mexico on October 11, 2021. The balcony was unprotected and was missing glass. Nico’s parents, James Carter and Anastacia Duboshina, have filed a lawsuit against Hyatt Hotels Corporation and related companies, alleging “inexcusable negligence” that caused “Nico’s tragic and entirely avoidable death.” The tragedy occurred when the Carter family was on vacation at the Hyatt Ziva Puerto Vallarta in Mexico. “Nico was standing right in front of me. You couldn’t see there was a pane of glass missing. I watched my son die in front of me. Nine floors up,” Nico’s father told CBS. He also noticed that Nico fell through an opening with a piece of safety glass missing from the balcony.

Nico fell onto the concrete platform after falling from the unprotected balcony. “I heard this scream from my husband. I had never heard anything like that before and I knew something terrible had happened,” said Duboshina, Nico’s mother. Images presented in the lawsuit show a sliding door that appeared to partially block the ninth-floor balcony, but had left enough room for the child to pass through. There were no cones, caution tape or other warnings. “In what world can a hotel be missing glass on the ninth floor of a high-rise hotel?” said the family’s attorney, Robert Francavilla. Regarding the hotel’s safety, Duboshina said: “We chose Hyatt specifically for its safety and because it was a kid-friendly resort, and that’s exactly what we wanted to do, take our child somewhere safe with us and just enjoy the beach and have fun with him there.” Nico’s father added that the family trusted Hyatt to have a safe environment, but they suffered a very tragic disappointment. Two years after their tragic loss, the couple sued the hotel, determined to prevent another family from having such a horrible experience. “No parent should have to go through that,” Duboshina said. “No parent should bury a child.” Through the lawsuit, the parents want the company to effectively ensure safety standards so that no other family has to suffer a similar loss ever again.
