Lydell Grant, 46, a Texas man who spent more than seven years in jail before being exonerated for a 2010 stabbing outside a bar is now accused of killing another man during a road rage incident.

Lydell Grant and an unnamed lady were leaving a corner store on Thursday at 11.50 p.m., according to Houston police, when Grant allegedly ran a stop sign and was struck by a Toyota. Then, according to reports, Grant got out of the car and fired several shots into the Toyota’s windscreen before getting back in and driving away. Edwin Arevalo, the 33-year-old driver of the Toyota, was pronounced dead at the scene, and Grant is currently being jailed on a $1 million bond as he awaits trial for murder.

Texan who was ruled innocent in one killing is now being held in another

The suspect was earlier freed from prison in 2019 after being convicted of not guilty in the killing of 28-year-old Aaron Scheerhoon. After six witnesses to the stabbing two years prior clearly recognized Grant as the perpetrator and gave evidence against him in court, he was found guilty of attacking Scheerhoorn outside a Montrose pub in 2012. Scheerhoorn, according to the police, was turned away from the club, and at the time, witnesses claimed to have seen Grant stab Scheerhoorn multiple times before running away. In 2012, Grant was found guilty.

However, he was freed from jail in 2019 after serving nearly eight years of a life sentence when the Innocence Project of Texas examined DNA evidence discovered on the victim’s fingernails, which did not implicate Grant in the crime. After finding Jermaico Carter in Atlanta, Georgia, where he had made his confession, police detained him for the murder of Scheerhoorn.

In a statement at the time, Harris County District Attorney Kim Ogg said: “The highest responsibility of a prosecutor is to see that justice is done and ensuring that we have the right individual charged is a baseline responsibility.” The Innocence Project’s executive director and Grant’s lawyer, Mike Ware, added: “We are relieved that Lydell’s wrongful conviction has had this important breakthrough.”

The Texas Court of Criminal Appeals ultimately found Grant not guilty in May 2021, whereas Carter admitted confessed to the murder of Scheerhorn last year. Grant was apprehended on Friday, according to investigators, who said surveillance video from the collision near the intersection of Hiram Clarke Road and Brentwood Park Drive helped them identify Grant as the shooting suspect. Now, Grant’s defense is making the case that he has been supporting his mother for the past six months by operating his own home cleaning service. They contended in court that the most recent charges on his criminal record date from 2009.

According to a statement sent to ABC 13 by a representative of the Innocence Project of Texas, “We are saddened by the news of this tragic event and our thoughts and sympathies go out to the victim’s family.” The representative continued, “As this is an ongoing investigation, we cannot comment on the specifics of this incident.” But he added: “We support Mr. Grant’s prior exoneration, which was approved by the Texas Court of Criminal Appeals.”
