Leevon Smith is accused of attempting to rob someone around 12:55 p.m. outside an apartment building in the 1300 block of West 90th Street when the officer interrupted and drew a handgun, Chicago police said.
An off-duty Chicago police officer warned a potential robber that he would kill him, then made good on that promise when he fired three shots at the man, footage from the wild scene showed. He is charged with one felony count each of aggravated battery in a public place and attempted robbery.

The police officer issued the threat on Jan. 17 after the suspect appeared to grab her gun minutes after she broke up a fight between four people, including the suspected robber, authorities said. As the two struggled and fell to the ground, the gun went off, hitting 39-year-old Leevon Smith, according to Chicago’s Civilian Office of Police Accountability (COPA).
“I’ll kill you,” he told Smith before the shots rang out. After the first two shots are fired, Smith says, “You got me, you got me,” according to audio and video of the incident released by the accountability office. The off-duty officer then said, “I told your fool I’d kill you,” as he fired the third and final shot. “Damn baby I’m sorry,” a hurt Smith responded, adding moments later. “I don’t want to die.”
The officer then yelled for someone to call the police as he continued to admonish Smith for trying to take the gun from him, video showed. “You thought he was playing a game, I told you I would shoot you,” the officer said. “I told your fool that I would shoot you,” the anonymous policeman also said. “You tried to steal my damn gun.” The images and audio are out of sync, COPA said.
Smith was taken to the hospital where he died two days later, CBS Chicago reported. Police said in January that the officer was placed on 30-day routine administrative duty. A tactical report indicates that Chicago police determined the suspect tried to grab the off-duty officer’s gun and was an imminent threat to it. The officer sustained a cut over her right eye, according to the police arrest report.
The officer was one of several people who called 911 after the shooting and told dispatch he was robbed and shot a man. “Oh my gosh, he just tried to rob me,” the shocked officer said on the call. She said that she tried to call her boss, but no one was answering her calls. “He just tried to steal my off-duty gun,” she told first responders on the scene. The officer joined the force last June, The Chicago Sun Times reported.
She has not been charged in the shooting, although Smith’s family is suing the city and the officer over the fatal encounter for $10 million, the newspaper reported. Prosecutors reportedly charged Smith with attempted robbery and aggravated assault, according to the arrest report prior to his death.
