Jose Vargas, a repeat drunk driver has been charged with murder after killing a mother and critically injuring her two children in a head-on accident, according to authorities.
Jose Vargas was driving along the wrong lane in his Chevrolet Tahoe when he collided with Lisette Villasenor’s Toyota Prius on the US-395 in San Bernardino last Thursday at about 6 p.m. Villasenor, 36, of Victorville, was driving her 12-year-old daughter Ashley and 6-year-old son Daniel, who was ‘enthusiastic’ on the final day of auditions for her cheerleading team, the California Allstars. Two air ambulances were dispatched to the scene. Villasenor and her children were rushed to the hospital, but the married mother-of-three died from her injuries. Daniel was transferred to the intensive care unit, while Ashley suffered moderate injuries. Vargas was unharmed and was carried away in handcuffs. Because of the suspected killer’s extensive rap sheet for drunk driving, the DA opted to prosecute him with murder.
Villasenor is survived by her husband, Humberto, and their older son Julian, as well as her daughters Ashley and Daniel. Vargas, of Adelanto, previously signed two statements admitting he would face a murder prosecution if another DUI offence resulted in the death of another person. He was still on probation from his most recent drunk driving incident in November. Ashley’s cheerleading squad has set up a GoFundMe page to help the family with medical fees after their lives were “tragically changed forever.”

Vargas had past drunk driving convictions in San Bernardino County, Orange County, San Diego County, and Los Angeles County, according to the DA. He was on probation for an Orange County felony DUI conviction at the time of the May 11 crash.
He signed two ‘Watson Advisements following DUI offences in San Bernardino in 2019 and the Orange County violation in 2022. ‘If I continue to drive while under the influence of alcohol, drugs, or both, and someone is killed as a result of that driving, I can be charged with murder,’ Vargas added in the signed declarations. The Watson Advisement was created after a California Supreme Court case in 1981. It means drunk drivers can be charged with murder even if they did not set out planning to crash and kill someone. Signing the advisement after a DUI means they are aware that getting behind the wheel drunk is an intentional act that threatens another’s life.
