Perry could face between 5 and 99 years in prison for shooting Garrett Foster, 28, during a BLM rally in Austin following the death of George Floyd. Despite prosecutors discovering that Perry made multiple racist and inflammatory social media postings and text messages about killing demonstrators before to the shooting, Texas Governor Greg Abbott has been lobbying for his pardon.
Prosecutors asked for a minimum term of 25 years in jail for Perry on Saturday, citing records that revealed his talks about killing Black Lives Matter demonstrators just before the shooting. Perry is deemed to have complicated post-traumatic stress disorder as a result of his deployment to Afghanistan and childhood bullying, according to forensic psychologist Greg Hupp’s testimony. He fired and killed Foster with a revolver through the window of his car after the Black Lives Matter protester motioned for him to roll down the window, even though Foster was holding an AK-47 assault rifle.
Perry said he acted in self-defense, but the Austin jury of 12 people rejected his argument. This decision was most likely influenced by Perry’s racist social media posts and text messages, which were made public for the first time during the trial on Tuesday. “I might have to kill a few people on my way to work because they are rioting outside my apartment complex,” one of them said. “I am officially a racist because I do not agree with people acting like animals at the zoo,” said one. “No protesters come near me or my car,” he says, adding, “I might go to Dallas and shoot looters.” His online search terms included “protest tonight,” “protesters in Seattle get shot,” “riot shootouts,” and “live protests in Dallas.”
Perry’s defense attorney, Douglas O’Connell, objected to the disclosure of Perry’s racist text messages and social media posts during the sentencing procedures, claiming that some of the words were taken out of context and that Perry has a right to free expression. O’Connell contended that some of Perry’s memes and messages were just “dark humor” and “barracks humor,” and that Perry’s military experience, which extended over a decade, should be taken into account. He requested that the judge sentence Perry to no more than 10 years in prison.
