Officer Cody Even Cheyenne Kackley of the West Siloam Springs Police Department was arrested Wednesday. He faces one felony charge of rape. The affidavit said he admitted that he “screwed up” and that he had “disgraced the badge” before breaking down in tears and being arrested.

According to a probable cause affidavit, the victim told police he was at the Cherokee Casino in West Siloam, more than 80 miles east of Tulsa, Oklahoma, with a friend on February 11. He drank up to 10 beers and had called his brother. for a ride home.
As she waited for him outside, she said she and her friend were suddenly surrounded by a group of West Siloam police officers, who told her she had been charged with an incident inside the casino, according to the document. They handcuffed her and put her in the back of a police car. After a while, she said police told her the charges had been dropped against her and let her go, the affidavit says.
She then asked Kackley to drive her home, thinking he was safe “since he was a police officer.” She told investigators that she and Kackley “flirted during the trip,” the affidavit says.
Kackley told her that he was going to turn off the police camera he was wearing on her and walked the victim to her front door, which the victim found “weird.” She said the sexual assault occurred inside a bedroom and ended when her brother entered.
Surveillance footage confirmed that she was severely intoxicated at the casino and she needed help to keep from falling, according to the affidavit. She had to be removed from the casino due to her high level of intoxication. Kackley referred to the woman as being “wasted,” investigators wrote.
Kackley initially told investigators that he didn’t believe she was drunk, but eventually admitted that he downplayed her intoxication “because he didn’t want to get arrested for what he did,” the affidavit says.
“Cody Kackley said that the victim had trouble remembering the events of the early morning and who she was with. Cody Kackley said that she would ask the victim a question, and within minutes she would forget the question due to her intoxication,” according to the document. “Cody Kackley admitted that the victim was heavily intoxicated during the time he was with her. Cody Kackley estimated her blood alcohol level to be about 0.20 based on her experience with intoxicated people.”
